Gigi Hoang

Gigi Hoang is an associate in the firm’s Commercial Litigation practice. Her experience covers a wide array of complex litigation and business torts, including trademark, unfair competition, false patent marking, trade secret misappropriation, false advertising, insurance coverage, and breach of contract. Gigi has also represented clients in labor and employment, bankruptcy, intellectual property, and E-Discovery matters.

She has represented a number of Internet and technology companies in litigating trademark and unfair competition claims, as well as privacy class actions alleging violations of state and federal security, Internet, electronic surveillance and communications laws. For example, Gigi was involved in representing a technology incubator in trademark, trade name, cybersquatting and unfair competition claims in federal court. She also was a member of the trial team for craigslist in its lawsuit against eBay in Delaware Chancery Court regarding corporate governance issues.

Currently, Gigi assists communications service providers in responding to government and other requests for lawfully authorized electronic disclosure and content under the federal Electronic Communications Privacy Act (ECPA), including under the Stored Communications Act.

Gigi has wide-ranging experience in electronic discovery. In particular, she has overseen and managed numerous large document collections, reviews and productions for clients to preserve, maintain and collect documents, data and information necessary for responding to investigative and litigation requests. She also has experience advising clients on appropriate document retention policies and procedures from companies in the United States and abroad.

Pro bono litigation is a key part of Gigi’s practice. She focuses on unlawful detainer actions, asylum actions, adoptions, and representing amicus curiae Human Rights Watch in support of the rights of same-sex couples to marry in California.
