The America Invents Act mandated that the USPTO encourage pro bono efforts to help small inventors obtain patent protection.  As we launch the California USPTO pro bono program, we will take a bit of time to explain the nature of the program, the underlying AIA mandate for it and the goals we hope it will achieve for inventors of modest means. 

Tim Burns spoke regarding the increase in financial fraud claims during the past several years and how it has caused policyholders faced with financial fraud claims to closely examine insurance coverage under financial institution bonds, blanket bonds, and similar insurance products.

Global businesses are facing unique compliance and third-party due diligence challenges as a result of new and pending legal requirements, such as those found in the California Transparency in Supply Chains Act, the European Union Directive on Transparency and its amendments, the Dodd-Frank Act’s pending “conflict minerals” disclosure rules, and the proposed federal Business Transparency on Trafficking and Slavery Act. This panel explores many of these new legal frameworks and evaluates the economies of scale that can be achieved by closely integrating corporate social responsibility and supply-chain issues into a comprehensive FCPA/anti-corruption compliance program.

The United States government is credited with bringing nearly 3 out of every 4 foreign anti-bribery cases worldwide, with Great Britain coming in at a distant second. But in the last several years, other countries as well as international organizations such as the World Bank, have begun to flex their anti-corruption muscle. This panel explores a variety of global anti-corruption developments, including the rising tide of a new enforcement phenomenon known as “carbon copy” prosecutions. This panel not only discusses how the very existence of these carbon copy actions has altered the way in which companies handle FCPA investigations, but also offers real world, practical insights on the subject.

In 2008, Perkins Coie Partner Howard Cabot began representing Guantanamo Bay Prisoner No. 707 -- Noor Uthman Muhammed, a Sudanese man accused of providing material support to terrorists. Howard shared Noor’s story and described some of the challenges of representing a Guantanamo Bay prisoner and navigating the military tribunals there. He also spoke about how his representation of Noor, and his other pro bono work, has enhanced his life and his career.

There is an increasing incidence of investigations initiated outside of the U.S. by international regulators that are generating investigations by the DOJ and SEC.  Pravin Rao's panel will explore the increased risk of concurrent or local prosecution by the DOJ and SEC, as well as their various foreign counterparts, and the potential collateral consequences.

On February 8, Christine Williams, Rick Oehler, Don Carney spoke at the National 8(a) Association's Winter Conference in Orlando, Florida.  Christine, Rick, and Don delivered a presentation entitled "Current Issues in Federal Suspension and Debarment" that covered Federal Acquisition Regulation suspension and debarment policies, procedures and contract clauses, strategy considerations in dealing with suspension and debarment issues, and special rules applicable to participation in the Small Business Administration’s (“SBA’s”) 8(a) program.

Patrick Collins led a one-hour CLE webinar on white collar crimes and government.

Many provisions of the AIA are scheduled to take effect on the 12 or 18 month anniversary of the AIA enactment, including first-to-file and post-grant review. Brewer), in which the Ninth Circuit Court of Appeals upheld the District Court's order enjoining the State of Arizona from enforcing a 2009 law eliminating family insurance benefits for lesbian and gay state employees, their domestic partners and domestic partners’ children.

The Electronic Communications Privacy Act ("ECPA") is the federal law that regulates how these types of services can access, use, and disclose information about their users and the communications users send through or store in the service.
