Kyle has more than 35 years of experience advising real estate clients on leasing, acquisition, disposition, development, and redevelopment.
Kyle B. Hettinger strategizes, collaborates, and negotiates complex real estate transactions on behalf of high-net-worth individuals, homebuilders, public and private companies, private equity funds, and renewable and traditional energy companies.
Kyle also has experience working with commercial mortgage-backed securities special servicers nationally with respect to real property real estate-owned leasing and dispositions of office, retail, and industrial properties, including leading title, survey, and other due diligence review.
Known for his efficient, practical approach and focus on clients’ core business objectives, Kyle’s diverse real estate practice has recently included representing a national landlord in the development and leasing of large-scale retail mixed-use projects and enclosed malls across the country, as well as representing data center owners and developers in the acquisition, leasing, and financing of Arizona data centers. Kyle has also represented a physician-led healthcare provider across multiple jurisdictions in build-to-suit and long-term leasing transactions for Programs of All-Inclusive Care for the Elderly and represented renewable energy companies in the leasing, acquisition, and development of solar and storage project sites.
His experience includes representing a global alternative asset manager in the acquisition and operation of a large, sustainable date farm operation based in California and Arizona. He represented a global green energy company in due diligence with respect to acquiring a green hydrogen project located near Phoenix. He also represented a large private equity fund in the sale of the iconic Arizona Biltmore Hotel.

- Represented CMBS special servicers in numerous REO matters, including sales of shopping centers, retail centers, hotels, office complexes and multi-use projects, and the leasing of commercial, retail and industrial space.
- Represented numerous banks, financial institutions and bank groups as well as numerous borrowers in a variety of multi-state financings, loans, workouts and repossessed real estate transactions, including loan documentation, disposition of assets, loan restructuring, judicial foreclosure, non-judicial foreclosure, deed in lieu transactions, lease transactions, zoning cases, CC&R matters and real estate and sales tax matters.
- Represented utility companies in leveraged lease financing of a $939 million, 400-megawatt coal-based generating facility in eastern Arizona.
- Represented utility companies in various acquisition and dispositions of gas, water and sewer assets.
- Represented utility company in various real estate financing transactions secured by its interest in the Palo Verde Nuclear Generating Facility.
- Represented developers with respect to master-planned communities, development of commercial power centers, and acquisition and development of various commercial and retail properties.
