Overview

Dave St. John-Larkin is a trusted advisor to leading technology companies about patent and licensing matters, particularly as related to software, telecommunications, and standard-setting. A patent attorney with nearly two decades of private practice and in-house legal experience, Dave regularly represents Fortune 500 clients with patent analysis and litigation matters involving complex computing systems, hardware, and software. He is fluent in more than a dozen computer languages, and he has devoted much of his career to resolving client matters related to audio and video codecs, databases, cloud-computing, wireless, machine learning, and content distribution technology.

Dave is an inventor of more than ten patents related to communications technology and has extensive experience working on patent and licensing matters involving next-generation communications standards and technology, including encryption, semiconductors, wireless, cable, satellite, networking, and Internet of Things (IoT) technology. As the co-chair of the firm’s Unmanned Vehicle Systems group, Dave is known for advising companies at the bleeding edge of technology, including artificial intelligence (AI), augmented reality and virtual reality (AR/VR), autonomous vehicles, blockchain, remote-sensing, and wearable computing companies.

As a leader within the firm’s Patent Analytics, Strategy & Solutions practice group, Dave also advises companies about enforcing and monetizing their patents. Leveraging the firm’s award-winning patent analysis software, Dave has successfully guided the offensive and defensive evaluation of third-party patent portfolios, in some cases exceeding thousands of patents. Dave also assists clients with litigation matters, product clearances, and non-infringement, invalidity, and freedom-to-operate opinions.

In addition to his focus on patent matters, Dave also counsels companies regarding licensing and contractual matters, particularly as related to open-source software and standard-setting. Having worked with clients to develop and implement open-source compliance programs, Dave is well-versed with numerous open-source licenses (including the GPL, LGPL, Apache, MIT, and BSD licenses), and he has opined on patent-related obligations derived from certain open-source licenses. On standard-setting, Dave has nearly two decades of experience representing clients involved directly or indirectly with standard-setting organizations (including standards promulgated by the ITU, ETSI, 3GPP, IETF, and IEEE). From evaluating the essentiality of patents to negotiating intellectual property rights (IPR) and membership agreements, Dave has extensive experience handling standard-setting matters.

Dave is well-known for providing outstanding client service. As a former in-house attorney, he is no stranger to the increased demands placed upon today’s corporate counsel. Dave thrives in an environment where he proactively partners with clients to solve their business problems, often by leveraging the firm’s technology solutions, and always by adhering to client deadlines and budgets.

Active in the community, Dave is a regular instructor and panelist on patent law topics. He is a board member of the Silicon Flatirons Center and is a past chair of the IP section of the Colorado Bar Association. Dave is also an avid drummer and longtime Rush fan.
