Government Contracting
We counsel companies in the broad federal procurement market. Many of our attorneys once worked for the government. In many cases, we know the government personnel involved in the procurement process, including contracting officials, attorneys and auditors. We understand how government agencies approach procurement, contract administration, and claims handling. We also counsel clients regarding state and local government contracting and have broad experience regarding small and small disadvantaged business issues, set-aside opportunities and program eligibility.
We help our clients negotiate prime contracts and subcontracts, ensure compliance with procurement regulations and protect their rights to technical and proprietary data. We also advise our clients about cost or pricing issues arising under fixed-price, cost reimbursement and sole-source contracts. In addition, we counsel our clients about various contractor compliance issues, such as the Buy American Act and equal employment and affirmative action requirements. Finally, we have substantial experience helping clients in dealing with government audits concerning pricing issues, cost accounting methods, and other compliance issues as well as with investigations relating to alleged contractor fraud, such as those involving the False Claims Act.
Government contract disputes, which are common, can involve a variety of claims and issues, including defective specifications, constructive changes, delay and disruption claims, claims for equitable adjustment, terminations, and bid protests.
